Patent Validation of European Patents in Turkey

The application of European patent applicants in the countries where they determine in accordance with their objectives has a great importance in the following periods.

Turkey is not a party to the London Agreement on translation. Therefore, each European patents are valid in Turkey if they are translated into Turkish and are filed in

Turkish Patent and Trademark Institution, the only Turkish official institutions.

The deadline for approval of European patent in Turkey is 3 months as of the date of the decision and it is not possible to extend this date. However, with the condition to make the application in a timely manner, it is possible to file application by giving the translation later.

In this sense, translation should be only in Turkish.

The translation shall be appropriate for the technical specification.

It is also possible for the European patent application to obtain temporary protection, by submitting TPMK (TURKISH PATENT AND TRADEMARK INSTITUTION) before the registration decision obtained from EPO when it is required to accelerate the application process and any correction of the Turkish translation is possible but it shall be valid only after the new publication.

After its validation in Turkey is made as to be valid in Turkey, the changes in specification are not allowed however in case of a proceeding, all corrections in European Patent institutions can be adapted to national validation.

When official approval of a European patent application to TPMK is requested, we expect it to be published within 2-3 months on average. An European patent certificate is only published electronically.
