Industrial design means all visuals on a product. Differences in quality that can be
distinguished from similar products in the market can be protected under industrial design registration.
Industrial design must be so different from the other products for not being confused with other products by the end users.
Why should I do a design registration?
In order to protect a design product in accordance with Decree Law 554, it must first be registered. Registration is a prerequisite for protection. Even if the provisions of unfair competition provide limited protection for unregistered designs, registration is mandatory in order to obtain the industrial design protection envisaged in Decree Law 554. Companies should also produce visual innovations for being protected from the bad influences of the competition and, most importantly, for being advantageous in competition, and they must take these innovations under protection with design registrations.
How can I make a design registration?
The product photographs or product illustrations are sufficient for registration application in drafts such as rendered solid models.
The protection provided by industrial design registration covers 25 years provided that the application is renewed once in every 5 years from the date of application. Industrial designs only provide protection for the countries where they are registered. In this respect, an industrial design registered in Turkey is valid only within the borders of Turkey.
